Overview:

GST Registration Online “Goods and Services Tax (GST)” is a type of  Indirect Tax. It is levied on the supply of Goods and Services in India. It is a destination-based tax, levied on almost every goods and service.

GST came into effect from 1st July 2017, after the GST Act approval in the parliament on 29th March 2017. Whereas, in the case of Intra-state, State Goods and Services Tax (SGST), and Central Goods and Services Tax (CGST), both are chargeable.

GST has three components:

  • CGST
  • SGST
  • IGST

CGST and IGST are levied by the Central Government whereas SGST is imposed by the State Government. IGST comes into the picture in case of Inter-state sale or supply.

In the case of Intra-state transactions, both SGST and CGST are levied.

The government of India has mandated to pay GST by every individual, and entity involved in the supply of goods and services. It is an act of the government to try to save the tax and the public from the cascading effect of taxes.

ELIGIBILITY:

When an individual or an entity is involved in any business activity and the turnover exceeds Rs. 40 lakhs (Rs. 10 lakhs for North Eastern and the Hill States), it is required to get registered under the GST Act as a normal taxable person.

A person or business is mandatory to get registered as per the guidelines. The process of getting registered under GST as a normal taxable person is known as GST Registration.

All the E-commerce operator, casual taxpayer, sales/service providers to other states, person/entity involved in supplying online information, NRI exporters and importers, businesses exceeding the turnover limits can easily get registered under the GST, and get its GST registration certificate and GST number within 1-5 days.

GST REGISTRATION PROCESS:

One can go for the registration either through any government portal or any GST Seva Kendra.
Let’s have a look at how can we go for registration online.

Go to the GST portal link, open ‘Services’ Tab and click on ‘Registration’ and then on ‘New Registration’.
Now select ‘taxpayer’ from the drop-down menu.
Fill the GST REG-01 form for new registration.
Verify the information through an OTP and click on ‘Proceed’.
After this, you will get a Temporary Reference Number (TRN), note it down.
Part A of the registration process completes here.
Now to start with Part B, log in with the TRN and enter the CAPTCHA code given on the screen.
Complete the OTP verification.
Now, it will redirect you to the GST registration page.
Enter the business information including the name of the company, name of the state of business, commencement date, and PAN.
Submit the details of promoters or partners as well, if any.
Submit the details of the person authorized to file GST return and also add the principal place of business, address, nature of possession of business premises, and official contact details.
Now, add the details of goods or services to be supplied, bank account details of the company, additional places of business, if any.
Upload the required documents and click on ‘Save’ and ‘Continue’.
After submitting it, sign it digitally and submit again to save your details.

After the submission, you will receive Application Reference Number (ARN), either via SMS or email to confirm the registration.

For Sole Proprietor or Individual:
PAN Card of the owner
Aadhar Card of the owner
Photograph (in JPEG format)
Bank Account details (extract of passbook/ bank statement containing the first and last page or a copy of canceled cheque)
Address Proof (Electricity bill copy/ ownership deed/ lease or rent agreement/ property tax receipt/ municipal khata copy)

For Partnership Firm and LLP:
PAN Card of all the partners
Copy of Partnership Deed
Photograph of all partner and authorized signatories (in JPEG format)
Address Proof of partners (Voters Identity Card/ Aadhar Card/ Driving License/ Passport)
Aadhar Card of authorized signatories
In the case of LLP, registration certificate/ board resolution of LLP is mandatory.
Bank Account details (extract of passbook/ bank statement containing the first and last page or a copy of canceled cheque)
Address Proof of principal place of business (Electricity bill copy/ ownership deed/ lease or rent agreement/ property tax receipt/ municipal khata copy)

For HUF:
Pan Card of HUF
Pan Card of Karta
Aadhar Card of Karta

For Companies:
PAN Card of the company
Certificate of Incorporation issued by Ministry of Corporate Affairs (MCA)
MOA/ AOA
Aadhar Card and Pan card of authorized signatory
Address Proof and PAN Card of all the directors
Photograph of all the directors and authorized signatories (in JPEG format)
Proof of appointment of authorized signatories (in JPEG format)
Bank Account details (extract of passbook/ bank statement containing the first and last page or a copy of canceled cheque)
Address Proof of principal place of business (Electricity bill copy/ ownership deed/ lease or rent agreement/ property tax receipt/ municipal khata copy)

Who should register for GST?

As per the government and CBIC guidelines, the following parties are required to go for ‘GST Registration’:

  1. Any business with a turnover of above Rs. 40 lakhs (Rs. 10 lakhs in North Eastern and Hilly States)
  2. Individuals registered under Excise, VAT or Service Tax, etc.
  3. E-commerce aggregator
  4. A casual taxable person or Non-resident taxable person
  5. Agents of supplier
  6. Input service provider
  7. Individual involved in supplying online information
  8. Individuals/ businesses paying taxes under the “Reverse Charge Mechanism”.

PENALTIES

What if someone is not registered under GST?

So let’s talk about penalties for not registering under GST.

  • An offender who is not paying tax or making short payments or not paying taxes as required under the GST Act has to pay a penalty of 10% of the tax amount subject to a minimum of 10,000 INR.
  • If the offender has deliberately evaded the payment of taxes, this penalty will be 100% of the due tax amount.
  • In case of a delay in filing GST, the penalty of INR 200 will be charged every day.
  • In the case of IGST, no late fee is chargeable.
